The Full Federal Court has confirmed Justice Cowdroy’s decision at first instance in the matter of Roadshow Films Pty Limited v iiNet Limited FCAFC 23, dismissing the appeal by the plaintiff in this matter. This essentially means that internet service providers are not liable for the actions of its users in matters where the users may be infringing copyrights through downloading films.
The immediate result is that ISPs do not need to contact customers or terminate the provision of their services to customers just because they received a notice from copyright owners.
